Good morning. It's 11 a.m. on the East Coast and 8 a.m. on the West. I'm Charles Coleman, Jr. sitting in for my friend and colleague Ali Velshi, and you're watching MS now. This week, we learned that the FBI has opened an inquiry into six Democratic lawmakers

whom Donald Trump accused of seditious behavior punishable by death.

Their alleged defense was releasing a short video reminding members of the military that they

must follow lawful orders and refuse unlawful ones.

In a statement Tuesday, four House members said the FBI contacted the

House and Senate Sergeant at arms to arrange interviews with the lawmakers. Meanwhile, the Pentagon

announced Monday that it's reviewing misconduct allegations against Senator Mark Kelly, a former U.S.

Navy captain to determine whether he could face court-martial proceedings for participating in

that video. Now, at least two Republican lawmakers have come to Kelly's defense. Senator Lisa

Murkowski called the accusations against him reckless and flat-out wrong. Senator John Curtis also

publicly vouched for Kelly's integrity. Treason, as it happens, is the only crime defined in the Constitution.

And as constitutional law scholar, Achille Amar, points out, the framers deliberately inserted

the word only into that clause the first and last time that the word appears in the entire

document.

Quote, treason against the United States shall consist only in levying war against them or in

adhering to their enemies, giving them aid and comfort.

Simply put, treason under the United States Constitution means waging war against the U.S.

or materially aiding its enemies.

The framers added that emphatic only because they knew the long and ugly history of kings

turning treason into catch-all offense for critics. According to my next guest, Akil Amar,

the founders wanted none of that abuse. So they added the word only.
