We're following new developments out of Minneapolis where the Minnesota Bureau of Criminal Apprehension,

the state police are now investigating the fatal shooting of 37-year-old Alex Preti by federal agents yesterday.

To be clear, the BCA are state officials.

They are currently at the scene. Our cameras are there.

They're taking photos and they're collecting evidence that is independent of that evidence that is

being carried out, being collected by federal authorities. The DHS has said no one else gets to

investigate this. The state is saying they want to investigate this, and this all comes after a Minnesota judge

late last night issued a temporary restraining order blocking federal agents from destroying

or altering evidence that is related to the shooting after the Department of Homeland Security

allegedly removed evidence from the scene and took it into exclusive federal custody. Federal authorities

also attempted to block the Minnesota Bureau of Criminal Apprehension from accessing the crime

scene itself. So the county attorney, what you would know of as a DA, the county attorney

Mary Moriarty of Hennepin County, Minnesota is the one who filed that lawsuit yesterday.

So it's really important for us to collect as much as we can and see if we have enough to make a decision.

And that decision will be, do we charge or not?

You are not discarding the possibility of charges in these cases.

No.

There were a lot of legal developments yesterday.

So this is a separate matter now.

In a new affidavit of sworn testimony, a doctor who was at the scene asked the agents

to be allowed to administer care to Preti after the shooting.
