Federal judges are ordering the early release of some January 6th defendants, including a man carrying

a Confederate flag and others who breach the capital security ahead of a Supreme Court

hearing on the legality of the obstruction charge against them.

The charge stemming from efforts to impede Congress's 2020 election certification

has been widely used but is now under scrutiny. If the Supreme Court finds the charge

unsound, those released might not return to prison.
