U.S. court halts order demanding Donald Trump return control of

California National Guard subhead. Appellate panel temporarily blocks lower court ruling that favored

Democratic Governor Gavin Newsom. I welcome Professor Richard Epstein of the Civitas Institute,

teaches law at NYU in the University of Chicago,

is going to help us pick our way through this battle in the courtroom. I mentioned the United States

Court of Appeals for the Ninth Circuit halted a lower court's ruling that just hours earlier

temporarily barred the federal government from deploying National Guards to Los Angeles

in order by the

President of the United States. So there is an opportunity for appeal. However, importantly,

the order to return the National Guard from controlled by the White House and the commander

in chief to the governor of California, who has objected for several days

that he was not consulted and he didn't give his permission, that order was written by Charles

Breyer, the San Francisco District Court judge who had issued the short-lived bar on federalizing

National Guard. The U.S. president's actions were illegal, said Judge Breyer, both exceeding the

scope of his statutory authority and violating the Tenth Amendment to the United States Constitution,

which defines federalism. Professor, this is a tangle of opinions all based on the same constitution.

Right now, my understanding is the National Guard has been used to guard federal and other

important buildings in Los Angeles and other cities.
