I'm John Batson with my good colleague, Professor Richard Epstein, who has joined his friend, John Yoo, from the Civitas Institute, to file an amicus brief to the court about

climate change. Well, it's a related issue. It has to do with nationwide climate policy being

set by one state and not at the federal

level. Have I said that correctly, Professor? I don't want to go too far into this.

Well, I mean, it's partly correct, but let me sort of put in a little bit more context. There

must be 20 states in the country, more coming, which have claimed that the mere decision to sell gasoline in your state makes you the fossil fuel companies that sell it responsible for sea rise around the world.

The theory of that sort had been accepted in a wide.

John and I, amongst others, filed briefs to the Supreme Court when

Biden was president to turn this thing down, and nothing happened. And so right now, there are two

cases in play. The case that you're talking about is the one from Colorado, where again, John and I

were active with the Mountain States Legal Foundation, Bill

Trackman and Ivan London. And we filed a brief, and they basically followed the court in Hawaii.

And that's the case which is going up. At the same time, there's another case, which is taking

place in Maryland where the decision was exactly the opposite way. And the court in a very pointed way said,
