Hi, this is Josh Marshall, and this is the Josh Marshall podcast with Kate Riega.

We didn't know yesterday, I think, what we would be leading off with today,

because kind of out of the blue, we've got another one of these big

exclusives from ProPublica about the Supreme Court, but this time it's not

Clarence Thomas, it's Sam Alito, and we first heard about this yesterday,

because Alito tried to scoop ProPublica basically by publishing his

response to their questions as an op-ed in the Wall Street Journal.

So basically, as we later found out, and this kind of became clear in the course

of when this op-ed was released yesterday, the people from ProPublica

reached out to Alito, I guess yesterday, or maybe it was the day before,

I guess it would have been the day before, something like that.

I said, here are our questions, and he didn't respond.

And then at some point a few hours later, or something like that,

his response shows up as an op-ed, and so he is answering the questions,

but also doing kind of like a pre-buttal, and getting in some attacks and

everything, and if you're a civilian, or if you're not like a Supreme Court

justice, there's nothing wrong with that, right?
