This is John Bacheler. I spoke with my colleague Richard Epstein of the Hoover Institution about the affirmative action decision and in specific

where San Jose Conor writing the majority opinion in Gruder 2003, which is now effectively overturned according to Clarence Thomas.

Where San Jose Conor found the 25-year limit she said that would solve affirmative action.

Richard wasn't entirely sure, although he said she spoke to a great number of people in business and in the military.

25 years is not up. There are five years to go. And yet the measure of the court is affirmative action is not effective.

It's discrimination and therefore must end. Here's Richard.

Well, what these guys are saying enough is enough. We've gone 20. No woman's made.

The idea that somehow we could use racially conscious projects to produce racially neutral result is not going to work.

And that's the famous line that Justice Roberts gave in the Seattle school case is the only way to end discrimination is to end discrimination.

The American left says we have to put everybody on life support to do it. The correct position is probably somewhere in between.

And my basic reaction to all nine Supreme Court judges none of them have ever run any kind of business whatsoever and which needed a management skills, not legal skills to handle this problem.
