This is John Batchel, a conversation with colleague Peter Berkowitz, the Hoover Institution,

about a letter going out over many signatures from right of center, scholars, and journalists,

to the government, the Trump administration, objecting to the unilateral decision-making of depriving Harvard University of Funds and condemning Harvard University

without the procedures that are built into reviewing a violation of Title VI of the Civil Rights Act.

And therefore, Peter is calling for attention to those details before and if a decision is made to cut off Harvard's funds and other punishments.

Peter Berkowitz, what needs to be done?

Not haste, that's for certain.

Well, they would like Harvard to immediately cease and desist, unfreeze all the funds,

and simply step back from the regulating of Harvard.

As you know, I think that goes too far because Title VI, properly understood, does give Harvard, sorry,

does give the federal government not only a right, but I believe a duty to ensure that federal

funds are not flowing to institutions, discriminating on the basis of race, color, ethnic orientation. But again, here's the catch.

The Trump administration has not followed the procedures that statutes dictate for withdrawing

federal funds. So hearings need to be held. Evidence needs to be gathered, that sort of thing.

So the Trump administration needs to go through those procedures before it freezes funds.
