Live from NPR News in Washington, I'm Jack Spear. Special Counsel Jack Smith is

signaling he plans to appeal a decision by a Florida judge to dismiss charges

against former President Donald Trump.

NPR's Carrie Johnson reports Judge Eileen Cannon ruled the prosecutor's

appointment violated the Constitution.

Judge Cannon, who was appointed to the bench by former President Trump said only Congress or the

president had authority under the Constitution to appoint a special counsel.

Her decision wipes away the entire classified documents case against Trump and hands him a major victory

at the start of the Republican Convention.

Now a spokesman for Special Counsel Jack Smith says they've been authorized to appeal the ruling. The Special Counsel says Judge Cannon has

deviated from all other judges who have considered the same issue over the years. A conservative

federal appeals court has already chided Judge Cannon in the case, but any appeal would add months if not longer to the process.
