A former Marine has been charged with second degree man slaughter in the death of a man

under New York City subway.

Video show Daniel Penny using a chokehold on Jordan Neely until he was unconscious.

NPR's quote Lawrence reports Penny is not yet entered a plane has been released on $100,000

bond.

Jordan Neely was a street performer.

He was homeless and acting erratically on a subway car last week.

And it's not clear he was violent toward anyone before several passengers restrained

him and Daniel Penny held him in a chokehold until after he was unresponsive.

Neely was black and Penny is white.

Demonstrations broke out after police questioned Penny and released him.

Protesters say that would never happen if a black man strangled a white man.

Penny is a former US Marine.

His lawyers say he was protecting himself and other passengers and did not intend to kill

Neely.

If convicted, he could face a 15 year sentence.
