Fox. Do you ever wonder how the Supreme Court became such a cultural battleground?

If we ask most of our fellow citizens to name all current eight members of the Supreme Court, do you think they could?

If we ask them to cite significant Supreme Court opinions authored by the late Ruth Bader Ginsburg, do you think most Americans

could?

And if they could tell us the result of those opinions or the conclusions reached, could

they tell us what analysis, which analysis she used to reach

those conclusions? In other words, what was her judicial philosophy? When you hear terms like judicial activism. judicial

philosophy. When you hear terms like judicial activism or judicial restraint, what do you think? When you hear

nominees described as textualist or originalist or minimalist. Do you believe you have a firm

grasp on what those terms mean? Supreme Court confirmation battles were not always like this.

For those of us old enough and bored enough to watch the Robert Bork confirmation hearings

and those that have followed since then, confirmation hearings hearings and it does make me wonder

confirmation hearings seem like just one more major thing to fight about.
