Houston Forensic Science Center, says Jocelyn Nongare was sexually assaulted prior to her murder. ABC 13 reports that the DA's office received the results from

the HFSC on Sunday.

Johann Jose Martinez Rangel 22 and Franklin Jose Pania Ramos 26 are charged with capital murder in Jocelyn's death.

According to Texas law, because of Jocelyn's age, both men were not eligible for the death penalty.

Talk about that in a moment.

However, Harris County District Attorney Kim Aug said that if sexual

assault were found that would make the case death penalty eligible and the state would then be able to ask for no bond.

An autopsy confirmed her cause of death was strangulation. Both illegals worked construction and asked their

boss for the funds after explaining what happened. So as I understand it, and this is a bit of a quirk in the law I was not aware of.

I think it's between the ages of 10 and 14.

So if you murder a little child at five or you murder a 15 year old, 25 year old, 35 year old,

45, 60, 70, 80.

And you know, certain factors are met, then it's a death penalty eligible.

But this 10 to 14, and I'm really not sure,

I don't believe that's ever come up. I don't believe I've ever heard that

discussed. I know we didn't discuss it in law school and I don't I don't recall

this ever being discussed in a case before.

Very odd. It seems like the sort of thing

we need to fix with state law. And conversations go, yeah, we got to put these

bastards to death.

I don't get as excited about the death penalties I used to.
