I'm John John Batch with my colleague in Fernando McCarthy of the National Review online,

updating on the trials and courtrooms for former president Donald Trump.

Jack Smith is a special counsel and there's a case in Florida about documents that were

mishandled is the allegation.

There's a case in Washington that I want to start with because it involves the January 6th

events and at this point the trial was to begin before now, I believe, or about now.

It's now indefinitely postponed.

And that is a revelation to me because it awaits the Supreme Court's decision on two cases,

one to do with the word obstruction.

Impossible for me to summarize that, so I'll let Andy do it, and the other

to do with the word immunity.

And he, is there an indication of when Mr Smith wants to start the January 6 trial as compared to the Florida trial.

The one thing we can say, John, is that Smith's staff, the prosecutors who work for him, have now publicly taken the position

that they don't think the Justice Department's so-called 60-day rule applies to Donald

Trump. So what that implicitly means is he would be willing to start a trial as late as September or October and try it right through election day if that was what was necessary to get this case done promptly.

The January 6th case that we're talking about even though there's a lot more to

it than January 6th but it's been estimated to be a two to three month trial so if

they begin it in September like say after Labor Day it would certainly go through election day.

60 Day rule is wise.

Suspending the 60 day rule introduces all kinds of storylines, checking on Florida,

you for some time, since that case emerged sometime in 22 I believe,

you've indicated that discovery here is going to be very difficult because we're dealing with classified

...
