Okay, Dreamers, we are going to pick back up right from where we left off, discussing the testing

of the tan t-shirt and the suspected planting of Kevin Cooper's blood on said t-shirt. Okay so we know that Kevin's E. D. A preserved

blood sample was taken when he was arrested, along with other E. D. A. Preserved blood samples from the victims, which were kept in an

evidence refrigerator, to which up to 20 people had ready access to. We also know that blood could be withdrawn from those

tubes without breaking any seals. And we know that anyone with access to that

refrigerator could take items in and out of it

without there being any record of it at all, without any written record.

This information coupled with the EDTA and the DNA findings we've just discussed,

strongly suggest that someone in the San Bernardino County Sheriff's Department

took blood from one or more purple topped EDTA tubes and placed that blood on the t-shirt.

And the district court did not account for the correlation between human DNA and EDTA in the control samples when it stated, quote,

while the extraction and measurement of EDTA in a sample may theoretically be accomplished, the ubiquity of E.D.A. in the environment

prevents any meaningful interpretation of the significance of an elevated level of E.D.A. within a forensic sample unquote.

Of that Judge Fletcher said, contrary to the view of the district court,

the data to demonstrate that a meaningful interpretation of the significance

of an elevated level of E.D.A. is possible. In fact, they demonstrate that the state's lab

test results were probably valid.

Neither the state's doctor nor Kevin's doctor were given the opportunity by the district court to look at both the EDTA and the DNA data.

When the state's doctor called contamination and withdrew his results,

he was not aware of Kevin's lab results.

He was also unaware of the results of the DNA testing by the state.

We are now able to see what the state's doctor could not see when he withdrew his test results.
