I welcome that is McCotter, my colleague and co-host, American Greatness, and Andrew McCarthy of the National Review Online and Fox News on the trials of Donald Trump.

We begin with a quote from Judge Juan Merchant, who has been the judge in charge of the

Bragg prosecution of Mr. Trump.

Way back at the beginning of the trials of Trump, this was the first one.

And at the time, it was the collective opinion of the media that it was the weakest of the cases.

However, it now remains the one standing.

The quote from the judge in Andy's piece on Fox News.

Finding no legal impediment to sentencing and recognizing that

presidential immunity will likely attach once defendant takes his oath of office, it is incumbent

upon this court to set this matter down for the public interest. Andy, a very good evening to you.

Judge Juan Merchant is talking about sentencing. I won't ask about

public interest. I will very much appreciate learning what the story is, why the judge wants to

sentence the president elect, knowing that once he's in office, the immunity is likely to obtain.

The main reason that Judge Merchant wants to impose sentence on President Trump is he wants

him to be formally a convicted felon under U.S. under New York law when he takes office,

when he is inaugurated on January 20th.

This is a major sticking point for Democrats.

I think Democrats nationally, for the most part, have abandoned their interest in this because they understand that lawfare as a general proposition in these various cases that we've been talking about as an electoral strategy not only fell flat, but was probably a negative.

But I think we always have to remember.
