Motion number two, which is also quite a good motion and almost never available to any defendant.

It's a motion in memorandum in support of a motion to dismiss the indictment on the grounds

that the indictment is fatally flawed because it results directly from a paradigmatic

violation of the appointments clause and the statute authorizing appointments of interim

U.S. attorneys, 28 United States Code, Section 546. I have a historical anecdote to relate with respect to

section 546. In my earlier capacity, I had direct involvement with that statute when I worked on the

Hill on the Senate Judiciary Committee, but that's just a preview of a very

exciting nugget, Joyce, for our very lucky listeners. What is this thing about?

Yeah, so this is about something that I just hate to wade into, right? This is the Vacancies Act

that governs how and when interim or acting U.S.

attorneys can be put into place when there's a vacancy. And the argument here is that the

administration didn't use the right process for making Halligan, a United States attorney.
