On Monday, the Supreme Court ruled 9 to 0 that Donald Trump will not be disqualified from appearing on the ballot in Colorado,

overturning what that state's Supreme Court had determined late last year. This means that

while Trump clearly engaged in insurrection, all legal challenges to his ballot access on that

basis are functionally dead. This was expected, but the ruling has a forward-looking dimension

as well. Coupled with the court's willingness to hear Trump's demand for full immunity from

prosecution for insurrection-related crimes, it raises serious questions about whether the court

is functionally placing Trump beyond accountability. It also raises

questions about whether Democrats should make a much stronger public case to that effect.
