former President Trump is appealing a ruling that he that threw out the classified

documents case.

This Judge Eileen Cannon ruled last month that special counsel Jacksmith's appointment

was unconstitutional, tossing the federal case charging former President Trump with mishandling classified materials after he left office.

Smith is appealing arguing to the 11th Circuit Court of Appeals that the lower court ruling is at odds

with widespread and longstanding appointment practices

at the Justice Department. Cannon's dismissal was the latest setback for Smith

he has also faced significant delays in a separate case in DC

accusing the former president of

attempting to overturn the 2020 election results. That case has been on hold

over immunity claims. Foxes, Jared Helper and the Trump and Harris campaigns accusing each other of changing

the agreed to rules of next month's debate.

The Harris campaign had told host ABC News that would like microphones to be live not muted when the other candidates
