This is the second part in our three-part series on the Real Housewives of Salt Lake City star, Jen Shah, and focuses directly on her arguments on why she should receive a sentence of 36-months. We are now in the second part of our series on Gen Shaw's Sentencing.

So now we are discussing now that Gen has pled guilty, what happens next?

And so when a person pleads guilty, they're not guaranteed what the sentence will be.

The district judge is going to take factors into account and determine what the appropriate

sentence should be. After a plea or a guilty verdict here, it was a plea, not a guilty

verdict. The guilty verdict would have come about had Gen Shaw gone a trial, but this was a plea.

We don't know if there would have been a guilty verdict. I'm just saying a guilty verdict comes

after a trial, but here she pled guilty. So then the federal Department of Probation issues

of report about the defendant and the crime. They have the opportunity to comment on the report

and inform the judge about anything relevant to the sentencing. Here, the government in Gen

stipulated to a guidelines offense level of 33, but there was still a PSR, which is a pre-sentencing

report recommending a specific sentence, and we'll discuss that as we go through both memorandums.

But it's still up to the judge considering certain factors as to whether or not they want to

deviate from the recommended sentence or the sentence that was within the plea. And so this is

where we're at now. Both sides have submitted sentencing memorandums. Gen Shaw submitted her first,

and then the government submitted theirs more recently, and we have them both, and they are both
