You know, folks, the coverage on the Stefan Stern's hearing, we covered a little, we

did a short show this afternoon, Professor Mike and I, and we got a little bit nervous

about the judge.

He's going to take two months to rule on whether or not Stefan Stern's voluntarily turned over his cell phone to Detective Myra Tagler.

And our feelings are, as former police,

who have gotten consent searches before,

is that it's totally, totally legit.

But the seriousness that this takes on is that this could really hurt this case

if this judge suppresses the evidence i.e. the cell phone and the the Google cloud the eye cloud where all those bad photos were on,

it could really affect this case. And you see the thumbnail there, fruits of the poisonous tree.

And that goes right from Adam and Eve, right? The fruits of the poisonous tree, except in the world of criminal

justice, what it means is that evidence that is obtained illegally will be suppressed.

And the law that guides that is the fruits of the poisonous tree, that evidence that was obtained or collected illegally

will be suppressed by the court.

But our position is here, and we don't matter because we're not the one wearing the black

robes, is that the police did exactly what they were trained to do.

And in this instance, a lot of people that I see in the chat saying, oh, the police screwed up.

No, they did not.

And another word that I want everyone to learn is called exigency.

Exigent circumstances.
