What they are attempting to do is criminalize what they consider to be disinformation.

And I have to tell you, this indictment is a really sad moment for me.

And I had hoped that if Smith was going to indict on January 6th, that he would find

unassailable evidence and unquestioned legal authority, he is neither in this indictment.

But what he does have is the criminalization of political speech.

So if he didn't follow it yesterday when old Jack Smith, the guy bringing this indictment

forward, came out, he gave a press conference, railing against Trump and the January

6th riot and made it sound like he was indicting Trump on incitement of the riot, but

then he didn't.

Which as Jonathan Turley said, the disconnect was glaring and concerning and indicted

in him all kinds of stuff that a lot of legal people, including people on the left think,

well, you're running into some real free speech problems here.

You get to say the election was stolen.

You get to believe that if lawyers are telling you that.

It's an odd indictment and ultimately will not be successful on any level.

I don't think as Turley also put it so brilliantly.

When you take a red pencil to anything that's protected by the First Amendment, this indictment

is reduced to a high coup.

One of my favorite pundits saying nobody knows for sure what the hell is motivating Jack Smith's

decision.
