This is a CBSI and the world. I'm John Bachelor. The Supreme Court Ethics Code, the New York Times reports Adam Liptak writing from Washington. The new Supreme Court ethics code released on Monday, November 13th looks good on paper, experts in legal

ethics say, but only on paper.

Its lack of an enforcement mechanism means that it will operate on the honor system with

individual justices deciding for themselves whether their conduct complies with the code.

I welcome Professor Richard Epstein of the Hoover Institution, a senior fellow, teaches law

at NYU and the University of Chicago.

Richard, a very good evening to you.

This is new information, and having read through the Supreme Court ethics code

a great deal of common sense.

For example, reading, writing, and lecturing are permitted and appearing at a fundraiser for a political candidate is warned against.

Nothing here is surprising to me. What is surprising is that what is driving this is an

unhappiness with the present makeup of the Supreme Court and the decisions of the

Supreme Court. Is this unprecedented?

Is this what the packing the court looked like in the 1930s? I can't tell Richard.

Oh, the 1930s seemed as a blip. It lasted for a little while. Charles Evans Hughes, the

canon of respectability sort of hinted and nodded, and everybody let it go away. The situation

you've seen here is one that has been going on for

literally years in which once the conservatives took over the court, the liberals

found everything to the tack on everybody on it and so they've've had a tax on public on various individuals and so forth. They spend their endless amounts of time talking about the immorality of the various decisions that these people make.

They talk about this ethics order in the same breath.
