I'm John Bache with my colleague Professor Richard Epstein of the Hoover Institution

teaches law at NYU and the University of Chicago. This is a report from these last hours,

UPI. Chief Justice John Roberts refused to meet with Senate Democrats to

discuss Supreme Court ethics issues stemming from two controversy of flags

flown over Justice Samuel Alito's properties.

If this is the first time you have heard of this matter, I'm not making making it up Richard will back me up.

Richard I begin by asking a frequently asked question of young people who are studying

the Constitution. Sep separate branch of government.

What does that mean when it comes to the Senate deciding it's going to have a heart to heart

with the Supreme Court's Chief Justice. Thank you.

And what it means is there are people in the Senate who believe that they could

bully the court into making sure that

the judges will have recusals from key cases, including the cases that either directly or

indirectly implicate Donald Trump and the behaviors of January 6th.

Sheldon White House is essentially a maniac on this issue.

Dick Durbin thinks that he can be attacked in his particular role in the Senate.

And so they're calling, they're summoned the Chief Justice to say,

we want to talk to you about who ought to be

recused. That's not the way to gain code. Separation of Palestine is much more complicated

than the simple statements that we want to give. This is a clear violation, but for example

there's nothing about the theory of separation of powers which doesn't give Congress the power

over the budget in terms of the way in which it funds the United States Supreme Court.
