I'm John Bachelor with John Malcolm, the Vice President of the Edwin Meese,

0:19.3

the Third Institute for the Rule of Law at Advancing American freedom. He's reviewing the new book by Molly Hemingway, which is a

0:25.7

biography of Justice Samuel Alito. Inside this is the drama turning around the leak of the

0:32.6

Supreme Court decision some years past, overturning Roe v. Wade. Apparently there is a great deal of drama

0:40.3

that comes through in these events. Chiefly, I'm focusing on the young man who claims that he

0:47.6

was ready to assassinate Supreme Court justices to change the direction of the law. It's all very fog of war. But in any event, John,

0:58.4

you believe that what we were witnessing in that period of time was the Supreme Court at great

1:04.0

risk. So as Justice Alito believe the same thing? Yes, he absolutely does. It was appalling. It was without question the most egregious

1:13.3

breach of confidentiality and protocol in the Supreme Court's history. And I'm sad to say that

1:18.7

there have been other leaks not quite as monumental since then. And the leak of Justice Alito's

1:25.0

draft majority opinion in Dobbs literally put a bull's eye on the backs of the

1:30.7

justices. And here's why I say that. An opinion is not official until it is released. Justices can

1:38.5

change their minds at the last minute. And so until all the justices have written whatever opinion is going to write,

1:45.9

majority opinion, dissents, concurrences, what have you, and opinion is not official. So here,

1:52.1

you had a draft majority opinion, a very strong opinion, clearly and definitively overturning

1:58.6

Roe versus Wade. And somebody could very easily come to the conclusion, okay, if I can take out one or more

2:06.5

of the justices in that majority, I may be able to prevent a majority from forming a final

2:15.0

opinion.

2:15.8

In fact, let's, for a moment, let's assume that Nicholas Roski, the guy who was

2:21.4

attempted to kill Justice Kavanaugh, and by the way, he had pledged that you actually wanted to

2:25.5

kill three justices. He didn't name the other two. But let's say he had succeeded. So what

2:30.2

ended up happening in Dobbs was you had five justices in favor of overcoming row.
