| 0:00.0 | From NBII Studios, this is Truth and Justice, a crowdsourced investigation in real time. I'm Bob Ruff. Hello everybody and welcome back to truth and justice. I'm sure you guys were all enthralled with the conversation we had with Andrew Burkhardt last week about the Delphi trial, Richard Allen's trial. And she's back with us again this week to now take us through what's happened since the conviction. And as you guys know, |
| 0:55.7 | I actually don't follow a whole lot of true crime and I get busy with other things. So I don't |
| 1:00.2 | know much of what's happened since then. I know there's a lot of appeals that are happening and a |
| 1:04.6 | lot of things in the works. So Andrea's going to help us break down what's been going on since the |
| 1:09.5 | conviction. Andrea, thanks for joining us again. My pleasure. So I'm just going to help us break down what's been going on since the conviction. Andrea, thanks for joining us |
| 1:11.3 | again. My pleasure. So I'm just going to just let you take it away and then we'll ask questions |
| 1:16.5 | along because I really don't know what's been happening. I see, you know, the occasional ex posts and |
| 1:22.9 | Instagram reels of people talking about things that are going on, but what's been happening since |
| 1:27.6 | Richard Allen was convicted last year? Well, this is actually a fairly quick answer because the |
| 1:32.4 | answer is it's been on appeal. And direct appeals, which are where the reviewing court is looking |
| 1:38.7 | at the process in the trial court to see if there has been some kind of legal error that undermines the reliability |
| 1:46.1 | of the outcome. These move at a very glacial pace. And so there was an extensive amount of |
| 1:52.2 | time where we were simply waiting for transcripts to be prepared for exhibits and in filings and so |
| 1:59.2 | forth to be transmitted up to the Court of Appeals. |
| 2:02.7 | The sort of benefit of that process for the folks watching the case is that a lot more of |
| 2:09.4 | the evidence was able to come to light and be publicly available as a result of that process. |
| 2:16.9 | There, of course, were gag orders and protective orders in place for discovery materials during the trial. |
| 2:24.5 | Judge Gull had put a bar basically on the public being able to view the exhibits during the trial process. |
| 2:32.3 | So the media was able to come up at the end of each trial day and inspect the exhibits that had been introduced that day, but we members of the public were not allowed to do that. And so this was really the first opportunity that the public had to be able to start to see a lot of what the case had been based on. |
| 2:53.2 | And then same with a lot of the underlying litigation that happened during the pretrial process. |
| 2:59.1 | Much of that litigation was done under seal or the supporting evidence for it was kept under seal |
| 3:05.7 | or just otherwise not available for the public to look at. |
