Last week, you heard all about how prosecutor Art Cotter framed the narrative to the jury about how Jody Hill must have killed DiMario Lowe's.

Today you're going to hear how Jody's defense attorney Ernie White countered that narrative in his closing argument.

As we've covered the trial, there's been example after example of how unprepared White was for this trial. He failed to properly cross-examine nearly

all of the state's witnesses and displayed an obvious lack of knowledge of the police case file.

White opened the door for Cotter to create his narrative, and this was his opportunity to undo that damage.

And White came out swinging at the very beginning of his closing, calling the state's case circumstantial and weak.

Quote, ladies and gentlemen, the prosecutor has gone on at some length, and I think necessarily so,

because we believe the case is fairly circumstantial and weak,

and he's working hard to plug up the holes to make it look like he's provided first-degree murder when he hasn't.

End quote.

White then goes on to try to separate the robbery from the murder.

Like I've said time and time again, the majority of this trial was actually spent litigating

the robbery rather than the homicide. Quote, the prosecutor has allowed to introduce evidence of a

robbery for one purpose and one purpose only. It's motive, to show motive for the murder.

The problem is, and the thing we feared from the very beginning, is that you get

caught up in the robbery, you get lost in that, and you say, well, geez, he did the robbery,

we don't have to worry about the murder. He must have done that. You've got a ton of evidence here

which relates not at all to the murder. It has no connection whatsoever with a whole list of witnesses.
