Today we are talking about a lawsuit against Tesla that is not the SEC case,

as well as Model Y pricing and a couple other headlines.

Tesla stock on the day-to- today did finish down 1.55% to

260.42 cents as compared to the NASDAQ down 0.03%. Just after market

closed today Reuters broke some news regarding a lawsuit against Tesla that is not from the SEC, but rather from a pair of Tesla shareholders who claim that Tesla was being misleading with their production guidance back during the model 3 ramp up,

causing these and other investors to purchase shares at an inflated value due to impossible to achieve guidance.

We've talked about this case on the

podcast before it was brought all the way back in October 2017. It was once

dismissed by a US district judge, but allowed to be refiled as an amended case. That amended case is what is in the

news today because the US District Judge again made a ruling and that ruling

was to dismiss the case. Furthermore and importantly from the court filing quote because the court from the court filing,

because the court concludes that any further amendment would be futile,

the second amended complaint is dismissed with prejudice

and without leave to amend."

So there are two pieces to that.

The latter half, the without leave to amend portion of the statement,

means that the plaintiffs have not been given permission
