Hello and welcome to the Saturday, March 23rd, 2019 edition of Tesla Daily on

official Tesla Podcast. My name is Rob Maurer. Today we are talking about in the pilot functionality. Tesla stock on Friday did finish down 3.46% to $264.53, this compared to the

NASDAQ down 2.50%.

That closing price was a five month low for Tesla.

All right, so as expected on Friday after market close, we got the Sir Reply by

Elon Musk's lawyers in the SEC contempt case.

There is a link to that in the show notes again, pretty short document.

The initial sentence in the document sums up the case nicely I think by saying, quote,

the SEC's reply makes clear that its effort to hold Musk in contempt relies on a radical reinterpretation of the order that would impose sweeping restrictions to which Musk never consented.

Musk's lawyers continue on providing evidence for this point of view by referencing the series of

tweets that the SEC included in their most recent response in this case.

In my opinion, the tweets that the SEC referenced there vary pretty significantly in terms of their materiality, but on the more immaterial

end of the spectrum, the SEC included such tweets as Musk saying, quote, Tesla is the safest car according

to U.S. government testing, testing and quote as well as a tweet

describing the benefits of electricity cost versus gasoline cost by saying quote and

because electricity costs much less than gasoline a model three can cost about $1,000 less per year to operate.

Because it's electric, there are no oil changes, smog checks, tune-ups, fuel filter, or brake

pad replacements.

End quote. If that replacements. End quote unquote material information to shareholders,

those people simply put should not be shareholders of Tesla.

I have no idea why the SEC would pick that tweet as an example, but to be fair on the other hand, they do include such tweets as Elon saying, quote,

looking forward to breaking ground on the Tesla Shanghai Gigafactory today, end quote.
