This is John Bachelor, conversation with my good colleague Richard Epstein, professor, senior fellow

for Hoover Institution, and teaches law at NYU in the University of Chicago about the reform recommendations

by President Biden in these last hours.

We address the term limits or the age question, and Richard takes it apart looks at all the pieces and says nine

is enough term limits are unworkable is Richard to explain. More of this later.

I most certainly am. Not because I'm not in Fine Health, but I just look at all my contemporaries

and some of them aren't in Fine Health. And that Lewin wrote this article saying, well, you know, Holmes wrote some of the Marinth and finds out. And that Lewin wrote this article saying,

well, you know, Holmes wrote some of his best opinions

when he was older.

And then you start looking at other justices

like poor justice requests,

and noticeably declined towards the end of his years and should have been off several years before he eventually resigned.

All of this stuff, no, term limits essentially is the preferred solution everywhere throughout

the world and it's one of the major

constitutional mistakes that they said we have to protect the independence of the

judiciary so you could only be fired if you're not in good behavior,

which is very hard standard to meet.

And so what we do is we have a lifetime.

Every new court that's created in the United States

is term limits, the bankruptcy court, the tax court.

They're not under Article 3.

We invent something known as an Article 1 court and give them term limit.
