On this week's episode of 5-4, Peter, Rianne and Michael are talking about school desegregation.

In this case, from 2007,

the Justices rule that education officials cannot use race alone to determine which schools students should attend.

The court was split 5-4 with a conservative wing led by Chief Justice John Roberts in the majority.

In Seattle schools where the racial makeup of the student population differed significantly from that of its district,

race was used as a tiebreaker in admissions.

Seattle argued that the policy was meant to create more equitable and diverse schools.

In his opinion, the Chief Justice called it racial discrimination.
