Hi from CNN. I'm Josh and Shana with the Five Things You Need to Know for Tuesday,

October 7th. President Donald Trump's attempts to deploy National Guard troops to Democrat-run

cities has led to the eruption of several legal showdowns. Let's start with Illinois. The

state in Chicago have sued to stop the federalization of National Guard troops from their state

and Texas. A federal judge has not blocked deployments for now, but is given the administration

until the end of the day tomorrow to explain why she shouldn't do so. And in Oregon, the White

House has asked an appeals court to pause an order from a judge in Oregon that halt National Guard

deployment to Portland.

These state legal battles come, as Trump said yesterday in the Oval Office, he's considering

invoking the Insurrection Act.

CNN's Elena Treene has more on what this means and where all these legal fights are

heading.

That is an 1807 federal law that was essentially allowed the president to federalize

the National Guard, send the U.S. military into some of these cities.

The president didn't rule it out.

He said he's not considering it right now, but if the courts continue to stand in his way,

he would be open to using it.

This is going to be a heavy battle fought in the courts. And as these battles play out, one of the most significant legal figures in the Trump
