I think this is a fact and law question in each case, determining and depending upon how cases go forward and a question of whether the Justice Department with its normal processes can continue.

We don't have an independent counsel statute anymore.

The Attorney General does in fact have the power to deputize somebody as a special counsel and bring that somebody within the purview of the Department of Justice, which they can then hire various prosecutors.

We know this is true as a matter of fact and we also know this is true because that's how Mueller was appointed.

There's a regulation at the Department of Justice that needs to be followed. That's all.
