So Michael Popoc, Legal A.F, I want to walk through the appellate process and the impact on other cases pending around the country of the new decision by one district court federal judge, Judge Alien Cannon Cannon down in Florida to dismiss the Donald Trump Maralago indictment

against him and his other co-conspirators

because she, for the first time in over 50 years and the only federal

judge to have so found, and overruling years of decades of appellate precedent has decided that the special counsel appointment by the

Department of Justice and Merrick Garland was invalid, improper and illegitimate under

the appointment clause and the apportionment clause of the Constitution.

It's a misreading of those statutes authorized by Congress to allow just this type of

prosecutor to be to be created by the Department of Justice

under the auspices of the Attorney General. It's a fringe theory. It'll be going up now.

However, it is now the ruling. She has now dismissed the indictment in

Moralago against Donald Trump just one business day after the shooting in Pennsylvania

and on the day of the Republican National Convention.

I don't think that political calendar and that the the roiling of the water since the

tragedy in Pennsylvania was was by accident or by happenstance. I think the timing of it was with a judge mindful of the political
