We are going to talk with an anonymous man who witnessed the entire accident in Dana Point,

the driver that crashed into the cyclist, killing him.

Van Roy Evan Smith is the driver's name.

He's being held on a million dollars bail.

He was charged on Friday.

He's accused of killing Dr. Michael Mamone Wednesday afternoon on PCH and Crown Valley Parkway.

If you watched any television news within the last few days, you probably saw the terrible video of Mamoan and his bike flying through the air, struck from behind.

And then, and this is what really stunned everyone, after hitting Mamoine with his car,

Ben Roy Smith, who's driving a white Lexus, jumped out of his car and stabbed Mamone with a large long knife.

People at the scene thought it was a machete.

And, you know, accidents involving bicyclists happen. But then when he jumped out and started stabbing Mammon,

and I don't know if Maimon died from his accident injuries or the stabbing injuries or both,

but nobody could believe this.

Anyway, Todd Spitzer, of course, his department is prosecuting in the case, Orange County, DA.

And we're going to talk with somebody who says they saw the whole thing happen.
