Summary

What do Charles Barkley, the National Guard, and the Posse Comitatus Act have in common? In this episode, of Law Talk with Epstein & Yoo, Professors Richard Epstein and John Yoo, joined by Charles C.W. Cooke, dive into the legal chaos surrounding the use of federal troops during civil unrest, whether Gavin Newsom could be overruled by the president, and what exactly the Constitution says about militias, insurrections, and executive power. John You, I have heard a rumor that you at some point in the past played horse at the

Supreme Court with Charles Barkley. Can this really be true?

0:39.8

1:40.7

you know, being from Philadelphia, given that Barclay spent his best years as a basketball

1:45.5

player in Philadelphia, I was pacing outside his office like a father waiting for the son to be

1:52.2

born or Dar to be born. And when he came out, I said, Justice, please let me take him on a tour of the

1:56.6

court. So Justice said, fine. So I got to spend an hour with Charles Barkley. I took him,

2:03.5

I mean, this was before iPhones. We have no photographic evidence, but it is true. I took him.

2:08.4

I had him sit in the chief justices chair where he could make rulings. I had him stand behind

2:12.9

the podium, making arguments. And he was playing it up. He was gesticulating and pointing.
