The controversy in Israel spills over into the front pages of American newspapers.

The controversy as I understand it from a great distance, hits the legislative branch

led by the Prime Minister against the Supreme Court, which isn't quite a branch because

it is important to underline what it is that is different about Israel's governance

from the U.S.'s governance.

And why those differences explain a deal of the frustration for all those who are interested

in the success of Israel.

I welcome one in particular, Peter Berkowitz, my friend of many years, he's the Tadden

Dianne top senior fellow at the Hoover Institution, writing most recently at Real Clear Politics.

Peter, I'm going to get to what I've seized on in your most recent article.

Israel lacks a constitution.

Therein lies a problem.

How does it work out in this present controversy?

Israel lacks a constitution, but it's important to appreciate, like the United States, Israel

has a declaration of independence, 1948, and in that declaration of independence, Israel's

founders made clear that Israel, the nation state of the Jewish people, will be a rights-protecting

democracy.

Now, it turns out, and we Americans know this, that the Constitution provides advantages

in protecting rights.
