Summary

In a rare admission of misconduct under his watch, Acting ICE Director Todd Lyons announced that two ICE agents are being investigated for lying under oath about their shooting of a Venezuelan immigrant in Minneapolis last month. The Justice Department and ICE initiated the internal investigation after reviewing video footage that contradicted the agents’ story. Asha and Renato discuss whether there’s been a cultural shift into lawlessness at ICE or if the incident is the result of reportedly super lax vetting of recruits to the agency. So, Asha, I mean, our topic today is something that I think is important and is different than what we've talked about in the

past. I mean, I think this is a subject that we haven't. We've talked about around the surface,

but maybe we haven't dove into. And this is coming up because we have breaking news this week

in two different fronts, where we have ice agents who, it appears, concocted a story, a false story that literally was

resulting in people being charged criminally with no reason at all. Okay. And then secondly,

we have some new news out of the Fulton County case that we have talked about.

But here, the issue of false statements in the affidavit, which we talked a little bit about last week, is really coming to a head.

Yeah. We should just dive into it because they're kind of extraordinary. And I mean, what we have been talking about around the edges is this idea of the presumption of regularity, which basically I now like mention it every episode.

And, you know, this idea that the government goes into court normally, I mean, until the Trump, this Trump administration

has always enjoyed a certain presumption that they have gone through normal,

a course of fact finding and investigation, and, you know, that what they're presenting is

a credible account. And I think this, these are specific examples that get to why we are seeing

in case after case that courts are increasingly unwilling to grant that presumption of regularity.

Yeah, exactly right, Ash. I mean, and I will just note, you know, these, some of the issues that we're talking about are things we've, that have echoes in prior episodes where we talked about, for example, there's a federal judge in Chicago who found that Mr. Bovino, who at the time was leading the operations, CBP operations, had lied to her on the witness stand.
