Andrew C. McCarthy, who is a senior fellow at National Review Institute in NR contributing

editor and a former assistant U.S. attorney for the Southern District of New York, one of the most reliable and

insightful legal experts in the country. And he has a new column that appeared in National Review

about the Comey indictment. James Comey, the former FBI director, has been indicted for threatening, apparently,

by taking a photograph of some seashells that were arranged on the seashore,

and those photographs had the two numbers, 86 and 47 in them.

And the claim, of course, is that anybody would read those numbers and understand that they

were a threat to the President of the United States.

That's a little bit of an oversimplification, but not too much, is it, Andy?

I don't, unfortunately, I don't think it's an oversimplification at all.

That's their case, and I think, Michael, it's why they don't have a case.

Okay, so the essence of this case is they are charging that this was a direct threat to the

President of the United States, which is illegal.

And they claim that they have evidence of the nature of that threat, but that's not been released yet,

to which you say. I'm highly skeptical, and I think what they say they have evidence about

as a legal matter is actually kind of beside the point.

To make this as simple as I can make it, every crime, every federal crime is a statutory

crime, which means it's based on a law that Congress has passed.
