Welcome back to the Dursho. I always miss you for the several days that we're not doing

the Dursho. You can always see me on locals which I do every single day. A few years ago

I was in Rockefeller Center about to go up to the NBC studios to do a television at the

view. And a guy comes over to me and puts his arm around me and says, Hey, I'm a big fan.

Here's the guy. I didn't know he was at the time. Now I know who he is. His name is something

like rock something. You know, he's become very famous for being slapped in the face by Will Smith.

And so I've been getting emails and calls from people all over with one simple question. Did

Will Smith commit a crime? Could he be prosecuted under California law? I am after all the expert in

that issue. And the answer is fairly clear. California law defines battery very, very broadly.

Any willful and unlawful use of force upon the person of another. And a number of cases give

as examples a slap on the face, a slap on the face, spitting at somebody. You don't have to

cause harm. It doesn't have to be violent. It's just an unlawful touching. And obviously what

happened at the Oscars last night was an unlawful and unwelcome touching. And in fact, the standard

instruction in California says, quote, words, no matter how appropriateness do not give you justification to

hit another person. So no matter what you might think of Chris rocks stupid joke. And it was a

stupid joke. I don't know whether he knew about the illness that afflicted Will Smith's wife that

caused her to lose her hair. By the way, she looks absolutely gorgeous. And let us say that. Yeah.

She looks absolutely gorgeous with her short crop hair. But it's not not the appropriate subject for a joke.

Look, I think many of the things that were said at the Oscars last night were not appropriate subjects for jokes.

Jennifer Lawrence, oh, you put on a little weight. No, you know, you don't talk about things like that. And

I think the Oscars have had bad humor for a long, long time. And there's a lot of inside humor,

you know, people making fun of each other and including making fun of each other's wives. And
