And now, Preston and Steve's news update with Kathy Romano.

0:13.0

It is Thursday, July 1st.

0:15.1

Good morning, Kathy.

0:16.3

Good morning in the news this morning.

0:17.7

Pennsylvania's highest court throughout Bill Cosby's sexual assault conviction and released him from prison Wednesday in a stunning reversal of fortune for the comedian, once known as America's dad, ruling that the prosecutor who brought the case was bound by his predecessor's agreement not to charge Cosby.

The 83-year-old flashed a V for victory sign to a helicopter overhead as he trudged into his suburban Philadelphia home after

0:38.2

serving nearly three years of a three to 10 year sentence for drugging and violating Temple

University sports administrator Andrea Constan in 2004. In 2005, I had come to the conclusion

0:49.7

that there was not enough evidence to arrest and convict him of former district attorney

0:54.0

Bruce Castor in an interview with 6 ABC. It's kind of wild because I got on my car yesterday. We had a little meeting and it popped up on the news. And that was like, you know, when you talk about the last sort of thing you would expect to hear. Oh, yeah. I was like, what? Oh, yeah. It came out of nowhere. Yes. Yeah, exactly, Kath. I had no idea that a ruling or some type was being made this week or anything like that. And I had no idea he was gaining any ground in whatever this case was. Didn't it just feel like, oh, okay, it's a futile effort that they have to do because they promise and they work from there. They're collecting a paycheck from them. Exactly right. And so, but this is ridiculous that this is ever going to be reversed. And then not only that, like, he was out. He was out. Out. But like they didn't even, even, like the media didn't even pick up on this being. Right. Being looming that it might occur. And it, but it is exactly the way it needed to occur because of this agreement with Castor, you just mentioned. And listen. And so that that is the way the law works. And, you know, regardless of the whole deal. But it's like, like we usually have a little bit of a thing being fed out. Hey, there's a possibility. They're talking to the judge. Just suddenly, bomb. He's out. Yeah, yeah, same thing. I'm no longer incarcerated. And listen, my friends and I were pretty tuned into all of this since the very beginning, my friend who works at NBC. So we've been talking about this. Right, right. And, you know, back to Bruce Castor, that's what we said the whole time. We're like, we just don't understand how this is happening since he made that deal. And sure enough, it wraps back around. And that's why Cosby's out. So he also explained, Castor explained why he made a promise to Cosby that this would, that it would never happen. The choices became do nothing or do something. I chose to do something, said Castor.

The former district attorney says it was that promise that Cosby would be forced to participate

2:38.8

in a deposition where he would be stripped of his ability to plead the Fifth Amendment and

2:42.9

ultimately provide Andrea Constan's attorney the ammo for a successful civil suit.

2:48.0

It's noted in the Pennsylvania Supreme Court opinion that Cosby even confessed

2:51.7

that in the past, he had provided quailudes, not Benadryl, to other women with whom he wanted to have

sexual intercourse. The Pennsylvania Supreme Court said Wednesday that district attorney Kevin

3:00.5

Steele, who made the decision to arrest Cosby, was obligated to stand by his predecessor's promise

3:05.4

not to charge Cosby, though there was no evidence that

3:08.5

agreement was ever put in writing. So you can sort of understand, okay, the try to lay the predicate

3:13.2

for a civil lawsuit at the time. So he agrees and parses out information thinking that it won't be

3:19.8

used against him in a criminal trial. Yeah. It was agreed. Right. And so that's the whole
