We begin tonight with news out of Colorado, where the state Supreme Court ruled 4 to 3 that Donald Trump is ineligible to appear on their ballot in the Republican Party's upcoming Republican primary.

Now, obviously, Trump is going to appeal this ruling, and it goes straight to the Supreme

Court. But there's no guarantee that the Supreme Court will take it, which means if they don't

take the case, Colorado could scrub Donald Trump's name, but other states would leave his name on the ballot.

This is got states like Maine, Minnesota, Wisconsin, and a few others, where it's still making

its way through their courts.

Conceivably, if the Supreme Court refused to take this case,

what we're looking at is a presidential election where Donald Trump's name will not be

on the ballot in all 50 states.

That's if the Supreme Court refuses to hear this case.

Unlikely.

They have to hear it.

The flip side to all this is the Supreme Court does take the case.

And then what?

Well, they could rule that the Colorado State Supreme Court over-extended its authority. They could rule that the Colorado state Supreme Court over extended its authority. They could rule that

Section 3 of the 14th Amendment doesn't include the President of the United States. That, if you

remember, we've gone over this. That is what the lower court in Colorado ruled last month.

The state Supreme Court overturned the lower court's reading of Section 3 of the 14th Amendment

and said Section 3 does apply to the office of the presidency. Without getting too deep into the weeds. The argument so far,

and this will be the argument when it gets to the Supreme Court, it gets down to whether or not

the president of the United States is an office, the same way the job of a senator or a congressperson is considered an office.
