California wants to establish its own rules about tariffs and tells the world about it?

Good evening, John. It raises kind of interesting constitutional questions as to what a California

governor can or cannot do. There is the Commerce Clause of the Constitution, for example, John, which

makes it pretty clear that it's up to Congress to drive trade policy. Now there's going to be some

legal conversation to be had about what Trump is doing vis-a-vis his use of National Powers Acts and so forth.

But the Constitution makes it pretty clear that governors don't do trade deals with foreign countries.

It's also the Logan Act, which we hear every few years involving private citizens who engage in foreign policy.

John Kerry got swept up with this, I believe, with Iran during the Trump

first White House as well with the Logan Access is that private citizens just do not do

foreign policy unless they are, you know, asked by the president to do so. And you could say that

the governor of California wanting to reach out to other countries and set up trade deals,
