Hey folks, this week on the Cafe Insider podcast, Joyce Vance and I discussed the reports

revealing that the Department of Justice is seeking testimony from former vice president

Mike Pence as part of its January 6th investigation.

Mike Pence is trying to cloak himself in separation of powers and executive privilege and talk

about what a terrible precedent it would set for him to testify, even though of course

he wrote a book and included all of this information and is making a buck off of it right

now.

But the bottom line is this, this is not a question of how the executive branch operates

and the need for some level of privilege.

This is about someone who is a fact witness to a crime, who is being asked to testify about

what he saw and heard.

And for Mike Pence to try to cloak that in some sort of constitutional armor and pretend

it's anything other than what it is, I think is really disreputable here.

I sort of have no shortage of words to condemn the way he's handled this.

Then we discussed the Mar-a-Lago documents case.

A panel of 11 circuit court of appeals judges recently signaled that they are likely to end

the special master review.

People who are formally in office are simple, private citizens like anyone else.

There may be some claims of privilege with respect to some information from the time they

were in office.

But otherwise, they don't get special treatment.

They don't get special privileges.
