Summary

It is bad enough the Supreme Court has been transformed from the central pillar of our justice system into a mood ring reflective the shifting views of the extreme right. But the damage that has been done to our legal system and our democracy at large now is visible at every level of the courts, state legislatures and in our Congress. We don't often connect the dots to see how serious the decay has been...but in this special one-on-one conversation with Dahlia Lithwick that's exactly what we do. It is a must-listen episode of Deep State Radio. Join us. Learn more about your ad choices. Visit megaphone.fm/adchoices

So there's so much to discuss, really. I could just sort of say talk about legal issues on your mind in 30 minutes from now. I'll just say goodbye to everybody.

2:06.5

But let's start with the ever-fascinating Clarence Thomas, who continues to remind us that there are no ethical standards for the Supreme Court, who seems to be shocking us nonetheless.

2:27.5

The most recent instance being this set of revelations about travel, luxury travel on mega yachts and private jets with a curious right wing financier, who is associated with various organizations that have issues before the court.

2:54.5

How do you see this? Is this just more left wing outrage that will echo for a moment in the Twitter verse and then disappear?

3:07.5

You know, a week ago, I think I believed it was nothing, or not nothing. It's clearly something, but there's been so many somethings reported about Clarence Thomas that does tend to sort of bounce around the Twitter sphere and nothing changes.

3:23.5

In fact, I think my headline last week was, and nothing's going to change. It's kind of been salient. It's landed in a big way. There's some pretty stunning numbers that the Washington Post showed some polling numbers that reflect that this actually has landed very poorly for Justice Thomas in the court and that Republicans, despite their incapacity to be outraged about Donald Trump,

3:52.5

are really pretty horrified by this as well. In other words, it's not just grumpy liberals who don't like Thomas's decisions, so this is a pretext to get rid of him.

4:03.5

It feels like across the board, this crosses lines for people, and I think it's clearly the moment in which folks like Senator Sheldon Whitehouse, who've been saying this for years and years and years, right, are pressing their advantage and having hearings about it,

4:21.5

and trying to force ethics codes onto the court. I actually think it might be, in some sense, the straw that if not breaks the camel's back, at least starts to penetrate the public consciousness that we have allowed this to go unchecked for too long.

4:39.5

Well, that's interesting, because his wife was one of the organizers and funders of a coup against the United States, and that would have seemed to be a big deal to me.
