سولفنا في هذه الحلقة مع فيصل السحيباني، الشريك المؤسس لشركة «مُلم» للمحاماة وصاحب العديد من الدورات التدريبية الموجهة لموظفي الموارد البشرية حول لنظام العمل.
تناولنا في البداية مدى أهمية الدور الذي يلعبه الوعي لدى الأفراد وأصحاب الشركات في تسيير نظام العمل، وبماذا تفيد المعرفة فيه وما أفضل الطرق لتحقيقها؟
كما حدثنا فيصل السحيباني عن أبرز الأخطاء الشائعة بين العقود محددة المدة وغير محددة المدة، وعن نظام الإجازات واحتسابها في الشركات وهل يتم إلغاء رصيد الإجازات بالكامل عند عدم استفادة العامل منه؟ كذلك حدثنا عن مدة التجربة الرسمية وهل هي مُلزمة بالفعل وما مدتها المنصوص عليها في نظام العمل؟
سألناه أيضًا عمَّ يترتب على إنهاء العقود ومكافأة نهاية الخدمة وكيف يتم احتسابها: هل على الراتب الأساسي فقط أم تمتد لتشمل البدلات أيضًا؟ وماهي المواد التي يتم من خلالها إنهاء عقد العامل في المؤسسات والشركات؟ وكيف تكون عقود عمل غير السعوديين وكيف تجري أمور الكفالة بالشكل الصحيح؟ وعن أبرز الأخطاء الشائعة فيما يخص الكفالة ورسومها.
كما حدثنا فيصل السحيباني عن كيفية التعامل مع عقود العمل في السعودية، وطريقة تجديد العقود محددة المدة ما إن كان تلقائيًا أم لا، وأهمية الإنذار بإنهاء العقود.
كل هذه الأسئلة يجيب عليها فيصل السحيباني إضافةً إلى حديثه عن الفصل والتعويضات المترتبة عليه، ونظام الإنذارات والجزاءات وأبرز الممارسات الخاطئة التي تحدث فيه.
