I'm Lee Silicera, Fox News, a federal judge has ordered the state of Texas to move a

floating barrier in the Rio Grande that was used to deter migrants from trying to cross

into the state.

The barrier, which went up in July, divides Mexico and Eagle Pass, Texas, part of Texas

Governor Greg Abbott's Operation Loan Star efforts to stop migrants from crossing the

southern border.

The U.S. Justice Department suing alleging state officials put the barrier up on the international

boundary without obtaining the required federal authorization, also citing environmental

and public safety concerns.

Texas is likely to appeal.

Governor Abbott has argued the barrier was legal, saying the Constitution grants Texas

sovereign authority to protect its border.

Fox's Christian Goodwin, the Delaware U.S. Attorney, who also serves as the special

prosecutor in the Hunter Biden case, says he plans to seek a new indictment against

the president's son in connection with the gun possession case, where Hunter Biden

was accused of having a firearm while being a drug user.

The prosecutors didn't say which charges they will seek.

The Georgia judge overseeing the election interference case against former president Trump

and 19 co-defendants, has made a ruling on how two co-defendants will be tried.

Judge McAfee did grant attorneys and co-defendants Sidney Powell and Kenneth Chesbro, a

speedy trial date of October 23rd, as is their right under Georgia law.
