Hearing the case, I'm Lee Silasera, Fox News, lawyers for former President Trump

in a Florida courtroom as they try to challenge the appointment of the Special

Council in his classified documents case and therefore the case should be dismissed.

Today really focused around multiple hours, several hours of very tense and technical legal arguments

from both sides.

Trump's team arguing that DOJ regulations don't actually allow for Attorney General

Merrick Garland to appoint a special counsel.

They believe that since special counsel, Jack Smith's appointment was unconstitutional,

Smith can't prosecute former President Trump in the case, therefore the case should be thrown out.

Special counsel Smith's team says that argument simply doesn't hold water.

Trump ally Steve Badden has asked the Supreme Court to delay his prison sentence

for contempt of Congress.

The emergency application came after a federal appeals court yesterday

rejected Bannon's bid to avoid reporting to prison by July 1st to service four months
