With the five things you need to know for Tuesday, August 27th.

Special Counsel Jack Smith is trying to revive the classified documents case against former President Donald Trump.

Smith is appealing to the 11th Circuit Court, arguing that Judge Eileen Cannon's decision

to end the case because the prosecutor's office lacked constitutional authority

doesn't have any merit. This comes as a dispute has broken out between Trump's

campaign and Vice President Carmelah Harris's team over the microphones at next month's debate.

Harris's campaign wants the mics to stay on the whole time, while Trump's team

says they've already agreed to the same format as his debate with President Joe Biden,

where the mics are muted when it's not the candidates turn to speak.

CNN's even McKend explains why the sides can't agree.

Ultimately the reason why the Harris campaign is pushing this is because they think

Trump without muted mics will interject rant, rant, rave, air grievances, and they want that

contrast up on that debate stage.

Trump, separate from his advisors though, does seem open to the idea.

Dangerous heat and humidity are expected to spread from the Midwest to the mid-Atlantic this week.

So far, more than 50 million people are under heat alerts and highs in the 90s to 100 degrees are possible. Some schools in the

Detroit and Philadelphia area have been ending classes early as kids head back

after the summer. Parents and students spoke to WXYZ.

This was a big problem last year.

The kids were complaining about they were so hot,

they come home, shirts dressed and sweat.
