Summary

Harry talks with top election law expert Marc Elias about the efforts by Trump and Republicans across the country to stack the deck in their favor for the 2026 midterms. They delve into the effort in Texas to gerrymander five new seats for Republicans. They then turn to the Department of Justice's extraordinary effort to acquire information from state and local officials, and the specific dangers it poses. They close with some thoughts about what all of us can do to fight back. It's always timely to check in with Marc Elias, but particularly now with the first signs of danger for the midterms. I'm your host, Harry Littman. Our guest is somebody I think about

0:24.4

at least twice a week when I read anything, I mean anything at all having to do with elections

0:30.6

and voting rights, because that is an area that seems to be very ripe for different kinds of attacks from the Trump administration and Project 2025.

0:43.2

I speak, of course, of Mark Elias, the founder of Democracy Docket, a leading digital news outfit covering the fight to protect voting rights and elections in the courts.

1:10.5

Thanks so much. Thanks for having me.

1:12.8

All right, let's cut right to the chase because a few weeks ago, we got what seemed like a pretty

1:20.0

alarming report of a broad effort from within DOJ, though maybe launched from other parts of the administration, just to kind of

1:30.4

get their fingers in, as best I could tell, state and local voting apparatuses and processes.

1:38.8

What the hell are they doing there?

1:41.8

Yeah, so look, this is one of the most concerning trends that I think has been underreported

1:47.8

on.

1:48.8

So I'm glad you, I'm glad you started with it.

1:51.3

We are watching as in state after state after state, the Department of Justice is seeking

1:58.1

really very granular confidential information about voters and voter roles in those states.

2:05.1

You know, every state obviously has to maintain a statewide voter database of who has voted

2:11.1

where they live, you know, when they registered, whether they voted in one primary

2:16.0

other. Obviously, they don't know who you voted for.
