I'm John Bachelor, this is CBS I on the world, that is,

Macara American Greatness this year, and Andrew McCarthy of the National Review

online doing us a favor of representing the representation of Special Counsel Smith's indictment of

former President Donald Trump to do with events of January 6th, 2021.

We come to the part, there are four charges, conspiracy to defraud the United States,

civil rights offense, and this, two counts of obstructing Congress.

The puzzle is, the Fisher versus the United States decision by the court

appears to say that obstruction cannot involve itself in the story that the

Special Council tells of January 6th.

It applies to destruction of documents in an entirely different universe.

But Andy, Fisher, is it addressed in the super cedar or is it ignored?

What we can deduce from the super cedar, John, is that Jack Smith believes that even after Fisher he has an obstruction case.

I believe based on what's known as the fake elector scheme. This was the idea that Trump and his campaign in the

states that they were contesting arranged to have alternative slates of Trump electors with the idea

that if they prevailed in any of these states in getting the either the courts or the Congresses or the legislatures of the

states to overturn the result of the election they would have these slights on

hand that would be able to cast the state's electoral votes for

Trump on January 6th. That was the plan. What these slights of electors did was prepared documents and actually submit them to the

national archives and to Congress purporting to be the authentic electors. Now I think it's important for their criminal state of mind

I think the electors didn't think they were fake they thought they were

contingent meaning they could fill all these documents out and be ready to vote, but they were

not going to be operative unless the state officially overturn the results of the popular
